Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Waitra website and AI virtual-waiter service (the "Service"), operated by Waitra ("Waitra", "we", "us"), based in Spain. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Waitra lets restaurants create an AI "virtual waiter" that answers customer questions about their menu via a QR code. Features and functionality may change over time.

2. Accounts

You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. You must be at least 18 years old and authorised to act on behalf of your restaurant business.

3. Subscription, free trial & billing

• The Service is offered on a subscription of €75 per month, with a 30-day free trial for new accounts.
• A valid payment method is required to start the trial. You will not be charged during the trial.
• After the trial, the subscription renews automatically each month until cancelled. Payments are processed by Stripe.
• Prices are exclusive of any applicable taxes (e.g. VAT), which may be added.

4. Cancellation & refunds

You can cancel at any time from your dashboard ("Manage billing"). If you cancel during the free trial, you will not be charged. If you cancel after billing has started, your subscription remains active until the end of the current paid period, and you will not be charged again. Except where required by law, payments already made are non-refundable.

5. Your content & responsibility

You retain ownership of the content you upload (menus, branding, restaurant information). You grant us a limited licence to process and display it solely to operate the Service for you. You are responsible for ensuring your content is accurate, lawful, and does not infringe anyone's rights.

6. AI accuracy & allergen disclaimer

Important: the AI waiter generates answers based on the information you upload and may occasionally be inaccurate or incomplete. The AI is a convenience tool and is not a substitute for professional advice. In particular, information about allergens, ingredients, and dietary suitability must always be confirmed with restaurant staff. The restaurant is solely responsible for the accuracy of its menu information and for meeting all food-safety and allergen-labelling obligations. Waitra is not liable for reliance on AI-generated answers.

7. Acceptable use

You agree not to misuse the Service, including: uploading illegal, harmful, or infringing content; attempting to disrupt or reverse-engineer the Service; or using it to violate any law. We may suspend or terminate accounts that breach these Terms.

8. Intellectual property

The Service, including its software, design, and branding, is owned by Waitra and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or code.

9. Availability & warranties

We work hard to keep the Service available and reliable, but it is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Waitra will not be liable for any indirect, incidental, or consequential damages, or for loss of profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or if required by law.

12. Governing law

These Terms are governed by the laws of Spain. Any disputes will be subject to the competent courts of Spain, subject to any mandatory consumer-protection rights you may have.

13. Changes

We may update these Terms from time to time. We will post the updated version here and change the "Last updated" date. Continued use of the Service after changes means you accept the new Terms.
